TERMS OF USE

Paddy Teacher Thinkific School  |   www.paddyteacher.com

Effective Date: 1 June 2026  |  Last Updated: 3 July 2026

1. Purpose of This Document

This Terms of Use Policy (“Policy”) applies specifically to your use of the Paddy Teacher school hosted on Thinkific (the “School”), and sets out the practical rules of use, platform requirements, conduct expectations, intellectual property protections, and refund terms for enrolled participants (“you”, “Participant”). It is intended for participants who have enrolled, or are considering enrolling, in a course delivered through the School.

This Policy incorporates and consolidates our Refund Policy as it applies to the School (Section 10 below), and works alongside our wider Terms of Service, Terms and Conditions, and Privacy Policy, all available at www.paddyteacher.com. Where those documents address matters not specifically covered here, they continue to apply.

Terms of Service: General rules for using our website and Platform as a whole.

Terms and Conditions: Enrolment, payment, licence, cohort scheduling, and certification terms.

Privacy Policy: How your personal data is collected, used, and protected.

2. Accessing the School

The School is accessed via Thinkific, a third-party learning management platform. Thinkific acts as our Data Processor and technology provider; it is not a party to your course purchase, and its own platform terms and privacy practices apply to the underlying hosting infrastructure in addition to our own policies.

You will receive login credentials or an account invitation upon successful enrolment. You must keep these credentials confidential and must not share them with any other person. Course access granted to you is personal and non-transferable, as set out in our Terms and Conditions.

2.1  Technical Requirements

To access the School, you will need a modern computer, tablet, or smartphone with a stable broadband connection (minimum recommended 5 Mbps). Supported browsers are the current versions of Chrome, Firefox, Safari, and Microsoft Edge, with JavaScript and TLS 1.2 enabled. Live webinar sessions may require a webcam and microphone if you wish to participate actively, though this is not mandatory for attendance.

2.2  Technical Support

If you experience difficulty accessing the School, logging in, viewing materials, or submitting assignments, contact our technical support team at [email protected]. We aim to respond within 24 hours on working days (Monday to Friday) and within 48 hours at weekends. Support covers login and password recovery, access to learning materials, assignment submission and feedback access, audio/video troubleshooting for live sessions, and device or browser compatibility issues.

3. Course Navigation and Progression

Courses are structured into sequential modules. Depending on the course, you may be required to complete modules in order, or progression may be open to allow free navigation; the applicable structure will be stated in your course dashboard. Where a live webinar forms part of the course, its date and joining details will be provided in advance through the School and by email.

Your access window (the period during which you may view course content) will be confirmed at the point of enrolment and is not extended except at our discretion or as required under our Terms and Conditions.

4. Intellectual Property, Content Protection, and Permitted Use

4.1  Ownership of Course Materials

All course materials made available through the School — including without limitation video and audio recordings, live webinar content, presentation slides, written text, downloadable resources, templates, worksheets, assessment materials, frameworks, and methodologies (the “Materials”) — are, and remain at all times, the sole and exclusive intellectual property of Paddy Teacher Ltd, protected under Irish and EU copyright law, the UK Copyright, Designs and Patents Act 1988, the United States Copyright Act 1976, the Canadian Copyright Act, and applicable international copyright treaties, including the Berne Convention.

Your payment for a course purchases a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the Materials for your own professional development, for the duration of your access window. No purchase, enrolment, or payment transfers any ownership, copyright, or other intellectual property right in the Materials to you, in whole or in part, under any circumstances.

4.2  Prohibited Actions

In using the School, you must not, whether personally or through any other person acting on your behalf:

4.3  These Are Not Merely Contractual Restrictions

The unauthorised reproduction, distribution, communication to the public, or commercial use of the Materials described in Section 4.2 constitutes copyright infringement under the copyright legislation of Ireland, the European Union, the United Kingdom, the United States, and Canada, in addition to being a serious breach of these Terms. Copyright infringement is a civil wrong that exposes an infringer to injunctions, damages, and an account of profits, and, in cases involving infringement carried out on a commercial scale or for commercial gain, may also constitute a criminal offence under the Irish Copyright and Related Rights Act 2000, the UK Copyright, Designs and Patents Act 1988, the US Copyright Act, and the Canadian Copyright Act.

Paddy Teacher Ltd takes the unauthorised use of its Materials extremely seriously. We actively monitor for unauthorised distribution of our content, and we will pursue all available civil remedies — including injunctive relief, damages, and recovery of legal costs — against any individual or organisation found to have infringed our intellectual property rights. Where infringement appears to have been carried out knowingly, systematically, or for commercial gain, we reserve the right to report the matter to the relevant law enforcement or copyright enforcement authority in the infringer’s jurisdiction for consideration of criminal prosecution, in addition to pursuing civil action.

A breach of Section 4.2 is treated as a material and fundamental breach of these Terms. Where we reasonably believe such a breach has occurred, we will immediately suspend or permanently terminate your access to the School without any refund or compensation, regardless of the stage reached in your course, and without prejudice to our right to pursue any further civil or, where applicable, criminal remedy described above.

5. Assessments, Reflections, and Academic Integrity

Where a course requires you to complete assessments, reflection tasks, or assignments, all submitted work must be your own and must comply with our Academic Integrity Policy, which is provided to you at the start of each course and forms part of these Terms. This includes ensuring that submissions genuinely reflect your own teaching context and are not copied, generated wholesale by artificial intelligence tools without attribution, or submitted on your behalf by another person.

Course tutors review submissions as part of our quality assurance process. Where a submission raises integrity concerns, we may request clarification, decline to certify the submission, or in serious cases, withdraw you from the course in accordance with Section 9 of our Terms and Conditions, without refund (see Section 10 below).

6. Live Webinars and Synchronous Sessions

Where a course includes a live, synchronous webinar, attendance expectations and joining instructions will be provided in advance. Live sessions may be recorded for quality assurance, Inspectorate review, and participant access purposes; by joining a live session, you consent to your participation (including any audio or video contribution you choose to make) being recorded for these purposes.

You are expected to engage respectfully with the course tutor and fellow participants during live sessions and in any associated chat or Q&A function. We reserve the right to remove any participant from a live session for disruptive, abusive, or inappropriate conduct.

7. Discussion Forums and Community Features

Where the School includes discussion forums or community features, you may use these to engage in professional dialogue with course tutors and fellow participants. Contributions must be professional, respectful, and relevant to the course. We reserve the right to moderate, edit, or remove any post that breaches this standard, and to restrict a participant’s access to community features where necessary.

Any content you post is subject to Section 5 (User-Generated Content) of our Terms of Service.

8. Certificates of Completion

Certificates of attendance and course completion are issued through the School only once you have met the certification criteria set out in Section 8 of our Terms and Conditions, including minimum attendance, completion of sequential modules, satisfactory assessment submissions, and compliance with the Academic Integrity Policy. Certificates are generated and stored securely and may be downloaded from your account once issued.

9. Data Collected Through the School

In the course of using the School, Thinkific collects data relating to your enrolment, course progress, quiz and assessment results, login activity, and content engagement, which we access as Data Controller in accordance with our Privacy Policy. This data is used to confirm certification eligibility, provide technical support, maintain the quality assurance records required for Inspectorate and accreditation purposes, and support the enforcement of Section 4 of this Policy.

10. Cancellations and Refunds

This Section sets out your cancellation rights and our refund policy for courses and downloadable file resources purchased through the School, and applies in place of any separate refund policy previously published.

10.1  Our Default Position

Once you have accessed any part of a course, or downloaded a purchased file resource, the sale is final and no refund will be issued, except in the specific circumstances set out in Section 10.4 below, or where you exercise a valid statutory cancellation right in accordance with Section 10.2.

All refund requests falling outside Section 10.4 are considered entirely at our discretion, as described in Section 10.5. This reflects standard industry practice among online course and digital resource providers, and the practical reality that digital content, once delivered, cannot be undelivered.

10.2  Statutory Cancellation Rights (Ireland, EU, UK)

If you are a consumer resident in Ireland, the EU, or the UK, you have a statutory right to cancel a distance contract within 14 days without giving a reason, under the EU Consumer Rights Directive 2011/83/EU as it applies to digital content, implemented in Ireland by S.I. No. 484/2013, and under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

This statutory right does not apply once you have expressly consented to immediate access to digital content and acknowledged that doing so ends your right to cancel, in accordance with Article 16(m) of the Directive and the equivalent UK regulation. At checkout, you are asked to expressly confirm that you want immediate access to the course or download, and that you understand and accept that your 14-day cancellation right ends as soon as access begins or the file is downloaded.

Accordingly: if you request a refund within 14 days of purchase and have not yet accessed any course content or downloaded the file, you are entitled to a full refund. Once you have accessed any part of the course, or downloaded the file, your statutory cancellation right has ended and any refund is governed by Sections 10.4 and 10.5.

10.3  United States and Canada

There is no general statutory cooling-off period applicable to the purchase of online courses or digital downloads in the United States or Canada. For participants in these jurisdictions, all sales are final upon purchase, subject only to the circumstances described in Section 10.4 and any narrow, non-excludable rights that may exist under applicable state, provincial, or territorial consumer protection law.

10.4  Circumstances in Which a Refund Will Be Issued

We will issue a refund in the following circumstances, which represent the full extent of our refund obligations outside of the statutory right described in Section 10.2:

10.5  Refunds Outside These Circumstances Are Discretionary

Outside of Section 10.4, we are under no obligation to provide a refund, credit, or exchange. We may, at our sole and absolute discretion, consider a partial refund or credit toward a future purchase in exceptional circumstances — for example, serious documented illness or bereavement preventing participation in a live cohort. Any such gesture is made without admission of obligation, does not set a precedent, does not entitle any other participant to equivalent treatment, and may be declined without reason being given.

The following, on their own, will not qualify for a refund: change of mind after accessing a course or downloading a resource; failure to attend a live webinar where a recording or asynchronous alternative was made available; failure to complete a course within the access window; dissatisfaction with content, teaching style, or approach where a preview or outline was available before purchase; withdrawal or removal from a course for breach of the Academic Integrity Policy or these Terms (including Section 4); purchasing the wrong resource without reviewing the published description; personal scheduling conflicts or changes in circumstance arising after purchase; and any request made an unreasonable length of time after the issue first arose.

10.6  Downloadable File Resources

Where you purchase a standalone downloadable resource, clicking the download link or accessing the file through your account constitutes access to digital content for the purposes of Section 10.2, and ends any statutory cancellation right at that point. Because the file remains permanently usable by you once downloaded, no refund will be issued for a downloaded file except where Section 10.4 applies.

10.7  Chargebacks and Payment Disputes

If a chargeback, dispute, or payment reversal is raised in respect of a purchase where no refund is due under this Policy, we reserve the right to contest the dispute using records of your acceptance of these Terms, access and download logs, and course engagement data; to suspend or terminate access to all Paddy Teacher products pending resolution; to decline future purchases from the participant or associated payment method; and to recover reasonable costs or fees incurred as a result of an unfounded chargeback, to the extent permitted by law.

10.8  How to Request a Refund

To request a refund, contact [email protected] with your full name, order or receipt number, course or resource name, date of purchase, and reason for the request. We aim to acknowledge all refund requests within 5 working days and to issue a decision within 15 working days.

11. Suspension and Termination of Access

We may suspend or terminate your access to the School, without refund, where we reasonably believe you have breached this Policy, our Terms and Conditions, or our Academic Integrity Policy — including, in particular, any breach of Section 4 (Intellectual Property, Content Protection, and Permitted Use). Where practicable, we will notify you of the reason for suspension and provide an opportunity to respond before any permanent termination of access. Suspension or termination under this Section does not entitle you to a refund and is without prejudice to any civil or criminal remedy available to us under Section 4.3.

12. Changes to This Policy

We may update this Terms of Use Policy from time to time to reflect changes to the Thinkific platform, our course delivery methods, our refund practices, or applicable law. Material changes will be notified to enrolled participants by email and/or a notice within the School. Continued use of the School following any update constitutes acceptance of the revised Policy.
